A Variance from Section <b>350-24(8)</b> where apartment buildings are required a 30-foot setback from the ultimate right-of-way and less than 30-feet is proposed and where no Use shall be created unless it complies with not only the road frontage but also the build to line; </span></p><p><span style="color: rgb(255, 0, 0);"><b>(ii)</b>. A Variance relief from Section <b>350-42(b)(1)</b> related to requirements for landscape buffers and screening and (in the alternative to the requested Special Exception); </span></p><p><span style="color: rgb(255, 0, 0);"><b>(iii)</b>. An interpretation of <b>Section 350-42(b)(2)</b> that buffering is not required on public road pursuant to the Ordinance, or variance relief from this section in the alternative;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(iv)</b>. Section <b>350-42(b)(3),</b> Buffer strip requirements may be modified by the Zoning Hearing Board as a Special Exception or in the alternative a Variance is requested;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(v)</b>. Variance from Section <b>350-42(b)(4)(A)(i)&amp;(ii</b>) to provide screening within the buffer strips; <b>(vi)</b>. A Variance from Section <b>350-48(d)(4)(E)(i)(1</b>) to permit a front façade of an apartment building in excess of 70’ on the same plane;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(vii)</b>. An Interpretation that Section <b>350-48(d)(4)(E)(i)(2)</b> requiring apartment buildings to front on an improved street in accordance with Section 350-42(g) or upon a courtyard or a close front said street is inapplicable;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(viii)</b>. An Interpretation that <b>350-42(g)</b> is inapplicable because proposed Lot 2 has frontage on Winchester Road and there is no minimum “Build-To” distance and the Applicant requests Variance relief in the alternative;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(ix)</b>. An Interpretation that <b>Section 350-24(8)</b> does not prohibit the parking area of proposed Lot 1 as depicted because it does not encroach into the front yard setback of proposed Lot 2, and the Applicant requests Variance relief in the alternative; </span></p><p><span style="color: rgb(255, 0, 0);"><b>(x)</b>. An interpretation of <b>Section 350-48(o)(2)(E)(ii)(6)</b> that the plan is compliant with the document provided for the access connection between separate parcels;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(xi)</b>. An interpretation of <b>Section 350-48(o)(2)(E)(iv)(1)</b> that the plan is compliant with this section regarding communication easements;</span></p><p><span style="color: rgb(255, 0, 0);"><b>(xii)</b>.
